1. Acceptance

These Terms of Use ("Terms") form a binding agreement between you and Mostly Marketing Inc. ("Mostly Marketing," "we"). If you do not agree, do not use the site.

2. The site and its content

All content on mostlymktg.com — including the AEO Citation Index, insights, articles, prompts, methodologies, graphics, and code — is owned by Mostly Marketing or its licensors and protected by copyright and other intellectual-property laws. You may view and share individual pages for non-commercial reference with attribution and a link back. You may not scrape, resell, redistribute, or use our content or data to train machine-learning systems without prior written permission.

3. AEO Citation Index — research, not verdicts

The AEO Citation Index is research output. Rankings, mentions, "cited/uncited" states, engine coverage, and market data are derived from automated probes of third-party AI systems (e.g., ChatGPT, Perplexity, Google AI Overviews, Gemini, Claude, and others) at specific points in time. Those systems change constantly and produce non-deterministic answers. Results may be incomplete, out-of-date, or wrong.

• Nothing in the Index is a statement of fact about any business's quality, competence, credentials, or fitness for a purpose.
• Inclusion or exclusion of any business is not an endorsement, disparagement, review, or accusation of wrongdoing.
• Business names, categories, and locations that appear are used descriptively for market research and commentary — protected fair use — and do not imply any relationship with, sponsorship by, or approval of the business.
• If you are a business owner and want a data point on your listing corrected, contact us via /contact and we will review it.

4. No professional advice

Content on the site — including insights, playbooks, audits, and Index data — is provided for informational purposes only. It is not legal, financial, medical, or other professional advice. You are responsible for your own decisions.

ChatGPT, Perplexity, Google, Gemini, Claude, and other product names are trademarks of their respective owners. References are nominative and for identification only; we are not affiliated with, sponsored by, or endorsed by those companies. Outbound links are provided for convenience; we are not responsible for third-party content.

6. Acceptable use

You agree not to (a) probe, scan, or test the vulnerability of our systems; (b) submit false information through forms; (c) use the site to violate any law or third-party right; (d) use automated tools to scrape content beyond what our robots.txt allows; or (e) misrepresent your affiliation with any person or entity.

7. User submissions

If you send us information (contact forms, audit requests, feedback), you grant us a non-exclusive, royalty-free right to use it to respond to you, provide services, and improve our research — subject to our Privacy Policy.

WE DO NOT WARRANT THAT AI ENGINES WILL CITE, RANK, OR MENTION YOUR BUSINESS AS A RESULT OF ANY SERVICE OR CONTENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOSTLY MARKETING AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, THE CITATION INDEX, OR OUR CONTENT — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS YOU HAVE PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

10. Indemnification

You agree to defend and indemnify Mostly Marketing against claims arising from your misuse of the site, your breach of these Terms, or your violation of any law or third-party right.

11. Changes and termination

We may modify the site, the Index, or these Terms at any time. Continued use after changes constitutes acceptance. We may suspend or terminate access at our discretion.

12. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Exclusive venue is in the state and federal courts located in New York County, New York.
